By accessing or using the ExpressWebChange website (the "Site") or any of our services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site or Services.
"We," "us," and "our" refer to ExpressWebChange ("ExpressWebChange," "the Company"). "You" refers to the individual or entity using the Site or Services.
ExpressWebChange primarily provides WordPress maintenance, development, and recovery services on a subscription and one-time-fee basis, including but not limited to:
Other content management systems and web frameworks (such as WooCommerce, Shopify, Webflow, or custom PHP/Python applications) may be supported on a case-by-case basis. Specific scope, deliverables, and limitations of each plan are described on the corresponding service page on the Site.
Subscriptions are billed monthly in advance through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method for the applicable subscription fee on each renewal date until you cancel or pause the subscription.
Subscriptions automatically renew at the end of each billing period unless you cancel through the Customer Portal or by contacting us.
Prices are in U.S. Dollars unless otherwise stated. Applicable taxes will be added in accordance with your billing location.
You may pause or cancel your subscription at any time through the Stripe Customer Portal accessible from the "Login" link on our Site, or by emailing us at info@expresswebchange.com.
If you pause a subscription, any unused days from the current billing period will be carried over to the next billing period when you resume.
Cancellations take effect at the end of the current billing period unless otherwise specified. Completed work is non-refundable.
If you cancel a subscription within seven (7) days of your initial signup and are not satisfied, you may request a refund of seventy-five percent (75%) of your first payment, provided no significant work has been completed for you. The remaining 25% covers onboarding and setup time.
One-time fees (including the SOS service) are non-refundable once work has begun.
Each subscription plan includes the specific items listed on the corresponding service page. Work outside the listed scope may be quoted as a separate fixed-fee add-on. We reserve the right to decline or re-scope requests that fall significantly outside the plan's intended use.

The Services may not be used to develop, host, maintain, recover, or otherwise support websites or applications whose primary purpose is any of the following. This list describes the nature of the work, not the identity or characteristics of any person or business; we apply it equally to all prospective clients.
We may decline to begin work on, or may suspend or terminate, Services for sites that fall within these categories — with or without notice. If a site's purpose is unclear at signup but is later determined to fall within these categories, we will refund any unused prepaid time on a pro-rata basis and end the engagement.
Separately, and consistent with Section 6, we may decline or re-scope individual requests within an otherwise-acceptable engagement on a case-by-case basis.
You retain full ownership of your website, content, and any deliverables we produce specifically for your site. We retain ownership of our internal tools, methodology, templates, and any general-purpose code or processes we use across multiple clients.
We treat your credentials, business information, and any non-public data you share with us as confidential. We use industry-standard tools (such as 1Password for Business) to handle sensitive credentials, and we will not share your information with third parties except as required to deliver the Services or as required by law.
The Services are provided "as is" and "as available." While we make commercially reasonable efforts to deliver high-quality work, we do not warrant that the Services will be uninterrupted, error-free, or that any specific result will be achieved. We disclaim all warranties, express or implied, to the maximum extent permitted by law.
To the maximum extent permitted by applicable law, ExpressWebChange's total liability for any claim arising out of or related to these Terms or the Services shall not exceed the amount you have paid us in the three (3) months preceding the event giving rise to the claim.
In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless ExpressWebChange and its representatives from any claims, damages, or expenses arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Services at any time, with or without cause, with reasonable notice. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (including 9, 10, 11, 12, and 13) shall survive.
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in Collin County, Texas, and the parties consent to the personal jurisdiction of those courts.
